1. Parties and scope
These Terms govern the relationship between EKSAND BİLGİSAYAR SANAYİ TİCARET LİMİTED ŞİRKETİ ("Eksand", "we") and anyone using the eksand.com website and the games and apps published by Eksand (the "Services"). By using the Services you accept these Terms. Where a product has its own terms (e.g. Sweet Belt Terms of Use), they apply together with these Terms and prevail in case of conflict.
2. Using the Services
You may use the Services only lawfully and for personal, non-commercial purposes. You must not:
- reverse engineer, decompile or modify the Services (except where the law expressly allows it),
- use cheats, bots or unauthorised third-party tools,
- attempt to compromise the security or infrastructure of the Services or other users' experience,
- copy, resell or distribute the Services without permission.
3. Accounts
Some Services may require an account. You are responsible for the accuracy of your information and the security of your account, and you can delete it at any time. In products without accounts your progress is stored on your device and may be lost if you change devices or uninstall the app.
4. User content
You own the content you upload. You grant us permission to store and process it only as needed to provide the Services. Illegal, infringing, hateful, harassing or harmful content is prohibited, and we may remove it and suspend the related accounts.
5. In-app purchases
Some products offer in-app purchases (e.g. removing ads, in-game items). Payments are made through Google Play or the App Store and are subject to the store's payment, refund and cancellation terms. Virtual in-game items (e.g. coins, boosters) have no real-money value, are non-transferable and cannot be exchanged for money. Statutory consumer rights that cannot be waived remain unaffected.
6. Ads
Our free products may show ads served by third-party ad networks. Advertisers are responsible for the products and services they advertise. Ad-related data processing is described in each product's privacy policy.
7. Intellectual property
The software, design, artwork, characters, music, logos and names such as "Eksand" and "Sweet Belt / Tatlı Bant" belong to Eksand or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services personally in line with these Terms.
8. Warranty and limitation of liability
The Services are provided "as is". We do not guarantee that they will be uninterrupted, error-free or compatible with every device. To the extent permitted by law we are not liable for indirect damages, loss of profit or loss of data. Our liability for intent or gross negligence and your statutory rights as a consumer remain unaffected.
9. Changes and termination
We may change, update or discontinue the Services and update these Terms; the current version is always on this page and important changes will be announced. We may restrict access if you breach these Terms. You may stop using the Services at any time.
10. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of Malatya have jurisdiction. Consumers may also apply to the competent consumer arbitration committees or consumer courts. Consumers in the EU keep the protection of the mandatory consumer laws of their country of residence.
